For the services it provides to its customers (virtual machines, dedicated servers, web hosting, mailboxes, backups), HOSTMYSERVERS acts as a hosting provider within the meaning of article 6-I-2 of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, of Regulation (EU) 2022/2065 on a Single Market for Digital Services, and of Law No. 2024-449 of May 21, 2024.

As such, HOSTMYSERVERS is not subject to any general obligation to monitor the content it stores. Its liability may only be engaged if, having been duly informed of manifestly illegal content, it failed to act promptly to remove it or to make access to it impossible.

Reporting illegal content

Any content hosted by HOSTMYSERVERS that you consider illegal may be reported at abuse@hostmyservers.fr. This address is also our point of contact for the authorities and for the recipients of our services under Regulation (EU) 2022/2065.

To be processed, your report must include:

• the date of the report;

• your identity: surname, first names, profession, address, nationality, date and place of birth for an individual; corporate form, name, registered office and legal representative for a legal entity;

• a precise description of the disputed facts and the exact location of the content (URL, IP address, domain name);

• the legal grounds on which the content should be removed;

• a copy of the correspondence sent to the author or publisher of the content asking for its removal, or the justification that this person could not be contacted.

Any report that is manifestly abusive or presents facts known to be inaccurate exposes its author to the penalties provided for in article 6-I-5 of the aforementioned law. Every decision to remove, block or suspend content is notified to the customer concerned with a statement of reasons.

8 Applicable law and dispute resolution

These legal notices and the use of this website are governed by French law.

In the event of a dispute, we invite you to contact us first at contact@hostmyservers.fr so that we can look for an amicable solution. Failing agreement, the dispute will be brought before the competent courts under the conditions of ordinary law.

Consumers retain the benefit of the protective rules of the French Consumer Code and of the mandatory provisions of the law of their country of residence, and may in particular bring the matter before the court of the place where they lived at the time the contract was concluded or where the harmful event occurred.

In case of discrepancy, the French version prevails.
